Condominium insurance: sign the petition to change 1074.2 C.C.Q

In 2019, with other management firms, we made a symbolic petition website to mobilize  co-owners against 1074.2 C.c.Q., this new article of the Civil Code caused many problems for condominium syndicates when it came time to recover sums incurred for claims whose costs were below their deductible, or simply the value of the deductible itself in larger claims.

Time has passed and it must be admitted that what we had decried then, has not improved in any way in the last 3 years. Despite the rewriting of article 1074.2 C.c.Q (March 2020), co-owners’ civil liability insurers maintain the same attitude and almost always refuse to compensate syndicates, instead denying the “fault” of their insureds.

This obviously causes a lot of anger among co-owners and directors who suffer the repercussions by having to capitalize annually a self-insurance fund that empties as it is assessed and by bringing an innumerable number of disputes within the condominiums.

Since 2019, we have founded the Association Québécoise des Gestionnaires de Copropriétés (aqgc.org) so that condominium managers can make their voices heard by the Government. It is therefore, today, this association that is taking up the torch of the reproach begun in 2019 in order to mobilize co-owners and directors, and thus force the legislature to amend article 1074.2 C.c.Q again and to settle the genuine issues affecting the condominium insurance sector.

If you had signed the 2019 petition on the ensemblecontre1074.com website, we invite you to sign this petition again, so your voice is heard by the National Assembly, because only the voices on the official petition count.

Also, we invite you to talk to all your neighbors, discuss it in assembly and post the following memo in your building.

We SIGN THE PETITION as many people as possible before February 8, because that is the deadline for the petition!
Do not forget to confirm your signature on the email you will receive from the National Assembly (Assnat) so that your voice is taken into account.
